We are pleased to announce that our Directors, Sr Andy Ng Ai Hua and Sr Loh Pooi Shun have recently obtained Certificate in Adjudication awarded by Kuala Lumpur Regional Centre for Arbitration (KLRCA).
The Construction Industry Payment and Adjudication Act 2012 (CIPAA) will introduce the concept of statutory adjudication in Malaysia. This is a form of dispute resolution that allows a party who is owed money under a construction contract to promptly obtain payment from the non-paying party. The entire process is governed by law (statute) and the dispute is decided by an adjudicator. Adjudicators have to be appointed by mutual agreement by the parties in the dispute or failing so, by the Director of KLRCA.
With KLRCA being appointed the official appointing authority under CIPAA and therefore, the only body recognized to train, certify and appoint adjudicators, KLRCA have embarked on an initiative to ensure that there is sufficient number of adjudicators in the country to be appointed when payment disputes in the construction industry arise.
Y. Bhg. Datuk Sundra Rajoo, the Director of KLRCA foresees a lot of adjudication work when the Act is fully implemented, and he hopes that there will be a wealth of accredited adjudicators on the KLRCA Panel of Adjudicators.
